New Italian law addresses online child pornography

On 6 February 2006, the Justice Commission of the Italian Parliament approved a bill entitled “Provisions on the fight against sexual exploitation of children and on child pornography on the internet." The new law also conforms to the provisions of a December 2003 EU Council decision.

The new measures are intended to toughen up existing legislation and give the police powers to arrest those who are responsible for significant amounts of child pornography online.  They also make provision for the crime of 'virtual pornography' - photos or video footage developed using a mix of real and unreal images, or only graphics.

The provisions also call for the creation of the National Centre to combat child pornography on the internet.  One of its aims will be to collect all of the reports on child pornography found online.  Internet Service Providers will have a legal obligation to adopt a filtering system to avoid access to sites censored by the Centre.

A National Observatory on child pornography will also be founded.  This will analyse data from the Centre, in order to understand the trends affecting the phenomenon of child pornography on the  internet in Italy.  The Observatory will also propose new strategies to combat and prevent the phenomenon itself.
